IOA executive committee elections on December 10

The Supreme Court while allowing the new date set by Justice (Retd) LN Rao Committee for the election of the Executive Committee of the Indian Olympic Association said that the elections will be held on December 10. Justices DY Chandrachud and Hima Kohli also allowed the IOA members to circulate the draft of the amended constitution as per rules for its approval in the general body meeting on November 10. The bench said it appreciates the promptness shown by Rao, a former apex court judge, in submitting the document on November 2 that he has taken this responsibility in the interest of the nation.

The bench said that Justice has interacted with all stakeholders including International Olympic Committee, IOA and state associations. The bench said, “There is a broad consensus with reference to this document submitted by Justice L Nageswara Rao that elections should be held on December 10, 2022. The offer is accepted. It further added, “The proposed amendments to the Constitution of the IOA will have to be circulated today itself so that the General Assembly may meet on November 10, 2022.” The proposal submitted in this regard is accepted.

The proposed amendments have been allowed to circulate. Justice L Nageswara Rao is at liberty to work out the modalities for dissemination of the proposed amendments. The bench said that Solicitor General Tushar Mehta said that Justice LN Rao has told that he will do the work assigned by this court free of cost. The bench also fixed a remuneration of Rs 20 lakh for Justice Rao, who drafted the Constitution, and said he would also decide the formalities for its dissemination among the members of the IOA.

The court also restrained courts across the country from allowing any petitions related to the draft constitution or the proposed election to the executive committee, saying such petitions would be heard only before it. “No other court shall entertain any petition relating to amendment in the constitution of IOA or election to the Executive Committee of the IOA,” the bench said. All objections of any person or party shall be presented only before this Court. The court has fixed the next hearing of the matter on December 7. The court had on October 10 allowed a stay on the IOA’s election scheduled for December 3 as the executive board of the International Olympic Committee is scheduled to meet on December 5.
